Terms & Conditions Policy

1. About Us

Heritage Traction Preservation (“HTP”, “we”, “us”, “our”) operates this shop to raise funds for the preservation and care of historic railway rolling stock. The shop is operated within the United Kingdom.

 

2. Scope of These Terms

These Terms & Conditions apply to all purchases made through our shop. By placing an order, you agree to be bound by these terms.

 

3. Products

​

We sell physical goods, including heritage railway items, memorabilia, and surplus components.

Product descriptions and photographs are provided in good faith. Due to the historic and used nature of some items, minor variations, wear, or markings may be present and do not constitute a fault where described.

 

4. Pricing & Payment

​

All prices are shown in GBP (£).

Prices include VAT where applicable, unless otherwise stated.

Payment must be made in full at the time of purchase using the payment methods offered at checkout.

We reserve the right to correct pricing errors and cancel orders where an incorrect price has been displayed.

 

5. Use of Funds

​

Unless otherwise stated, proceeds from sales are used to support the preservation, restoration, storage, transport, and operation of our rolling stock and related heritage activities.
Purchases are not donations unless explicitly described as such.

 

6. Order Confirmation

​

An order is only considered accepted once an order confirmation is issued.

If we are unable to fulfil an order, a full refund will be provided.

 

7. Delivery

​

Delivery times are estimates only and not guaranteed.

Risk passes to the customer once the item has been delivered to the address provided.

Customers are responsible for ensuring delivery details are correct.

 

8. Right to Cancel (Consumer Contracts Regulations 2013)

​

Customers have the right to cancel an order within 14 days of receiving the goods, without giving a reason.

To exercise the right to cancel, the customer must provide clear notice within the 14-day period.

Effects of Cancellation

​

Goods must be returned within 14 days of cancellation.

Items must be returned in the condition received.

Return postage costs are the responsibility of the customer unless the item is faulty or incorrectly described.

Refunds will be issued within 14 days of receiving the returned goods.

 

9. Exclusions to the Right to Cancel

The right to cancel does not apply to:

Custom-made or personalised items

Digital content once accessed

Items sold clearly as surplus, spares, or untested, where the condition is fully disclosed

10. Faulty or Misdescribed Goods (Consumer Rights Act 2015)

​

Where goods are faulty or not as described, customers are entitled to a refund, repair, or replacement in accordance with UK consumer law.
Statutory rights are not affected by these terms.

 

11. Used & Heritage Items

​

Many items sold are historic or previously used railway equipment. Cosmetic wear consistent with age and service use does not constitute a fault where clearly described.

 

12. Liability

​

We are not responsible for losses arising from misuse of any item purchased.

Liability is limited to the purchase price of the goods, except where UK law requires otherwise.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence.

 

13. Intellectual Property

​

All branding, logos, photographs, and written content remain the property of Heritage Traction Preservation and may not be reproduced without permission.

 

14. Governing Law

​

These Terms & Conditions are governed by the laws of England and Wales, and disputes shall be subject to the jurisdiction of the UK courts.

 

15. Changes to These Terms

These Terms & Conditions may be updated at any time. The version in force at the time of purchase will apply.

Digital Product Policy

1. Digital Products

​

Digital products are items supplied in digital form and made available for download or access after purchase.

Once a digital product has been accessed or downloaded, it is considered delivered.

​

2. Delivery of Digital Products

​

Digital products are typically delivered via download link or online access after payment is confirmed.

It is the customer’s responsibility to ensure their device and software are compatible with the digital product.

Download links may be time-limited or restricted to a set number of downloads.

3. Right to Cancel

​

Under the Consumer Contracts Regulations 2013, you lose your right to cancel once:

The download or access to the digital content has begun, and

You have agreed that delivery can start immediately and acknowledged that you will lose your right to cancel.

If a digital product has not yet been downloaded or accessed, you may cancel within 14 days of purchase.

4. Faulty Digital Content

Under the Consumer Rights Act 2015, digital content must be:

Of satisfactory quality

Fit for purpose

If digital content is faulty, corrupted, or not as described, you are entitled to:

A repair or replacement, or

5. Refunds

Refunds for digital products are only available where the content is faulty, corrupted, or not as described.

No refunds are available for digital products that have been downloaded or accessed and are functioning as described.

Digital products are supplied for personal, non-commercial use unless explicitly stated otherwise.

You may not copy, share, redistribute, resell, or reproduce digital products without written permission.

All intellectual property rights remain with Heritage Traction Preservation.

Customers are responsible for securely storing downloaded digital products. We are not responsible for loss of files after download.
